Tim Means off UFC on Fox 5 after he slipped in the sauna when cutting weight

Just over 24 hours from the start of UFC on Fox 5, the card had one more change due to an accident that puts some stock in the theory the UFC is cursed in 2012.

Lightweight Tim Means was supposed to face Abel Trujilo in the preliminary fights that will air on FX on Saturday. While cutting weight for Friday's weigh-in, Means slipped and fell in the sauna. UFC president Dana White tweeted Means knocked himself out.

LeVesseur had been scheduled to fight Michael Chiesa, but he scratched late last week due to illness. Now, he's back on the card and preparing for the next day for his opponent. Most fighters prepare for an opponent for at least six weeks.

The UFC has had a run of injuries in 2012 that bordered on unbelievable. Champions Dominick Cruz, Jose Aldo and Georges St-Pierre all took extended breaks from fighting because of injury. Dan Henderson's knee injury before his scheduled UFC 151 bout with light heavyweight champ Jon Jones led to the cancellation of the Labor Day weekend event. In May, the all-heavyweight main card of UFC 146 had to be reworked several times because of injury.

And now, even as the end of 2012 nears, Forrest Griffin and Chris Weidman both had to pull out of the year-end UFC 155 event. This is all topped off by a fighter slipping and falling the day before an event. 2013 can't come quickly enough for the UFC.

Supreme Court criminalises offences within the exercise of freedom of assembly, expression thumbnail

The Supreme Court decided in a 6-1 ruling last week that the police should investigate criminal offences carried out within the exercise of the rights to freedom of assembly and expression.

The ruling comes in a case filed by the Attorney General in September requesting the court to determine that public disturbances in the name of political protests were not within the scope of the rights guaranteed in the constitution.

These included protests outside private residences late at night, use of defamatory language and incitement to violence ? ?calling for people to be killed, hanged and attacked.?

The Supreme Court was asked to declare that such actions infringed upon the right to life, liberty and security of persons (article 21); the right to privacy and respect for private and family life (article 24); the right to protect reputation and good name (article 33); and special protection for children, young, elderly and disadvantaged people (article 35).

The apex court ruled that activities that violate ?public safety, health, tranquillity and morality? could be considered criminal offences and falls within the purview of the security services.

The case was filed by the Attorney General following months of protests by the formerly ruling Maldivian Democratic Party (MDP) and the dismantling in March of the party?s protest camp by security forces.

President?s Office Spokesman Masood Imad told Minivan News last month that the government fully supports the right to protest, but it needs to be done in such a manner that does not adversely affect the lives of others.

?A protest should be about changing something. A protest conducted in residential areas has nothing to do with parliament. Public protest and public nuisance are two very different things,? he contended.

The MDP meanwhile likened the move to Bahrain?s efforts to outlaw protesting.

?The MDP strongly condemns efforts to restrict freedom to assembly by the government. One of the most fundamental clauses in the new constitution is the right to protest and we are witnessing democratic gains fast slipping,? said MDP Spokesperson?Hamid Abdul Ghafoor.

Dissenting opinion

In his dissenting opinion, Justice Ahmed Muthasim Adnan ? the only Supreme Court Justice with a background in common law ? concluded that establishing a judicial guideline for the exercise of rights and freedoms was not within the remit of the Supreme Court.

He contended that such principles ?should be determined in a law passed by the People?s Majlis.?

Justice Adnan noted that the case was considered ?ex parte? or conducted for the benefit of one party.

He noted that according to article 16 of the constitution, the rights and freedoms enshrined in chapter two were ?subject only to such reasonable?limits prescribed by a law enacted by the?People?s Majlis in a manner that is not contrary?to this Constitution. Any such law enacted by the?People?s Majlis can limit the rights and freedoms?to any extent only if demonstrably justified in a?free and democratic society.?

It was therefore clear that rights and freedoms could only be restricted or narrowed through a law passed by parliament, Justice Adnan added.

The Attorney General?s request was not a matter to be decided by the Supreme Court, he concluded, as ?these problems should be proposed to the People?s Majlis for a solution.?

the New School: Gigantic Brewing's Ume Umai beer debuts at ...


Portland's is getting a taste of Japanese pub culture this Friday 11/16 when our first ever Izakaya festival takes place at the Jupiter Hotel. This unique fest shines a spotlight on Japanese art, cuisine, shochu, sak? and beer for NW drink connoisseurs and foodies alike. With Portland's craft beer-minded consumer in mind the festival has wisely teamed up with Gigantic Brewing to create a beer called "Ume Umai" brewed with Black Rice and Plums just for this event.


Izakaya is a Japanese word for pubs, drinking establishments that also serve food and cater more towards the casual drinking class for after work refreshment. Much like the brewpubs and gastropubs we make our 2nd home Japanese pub culture is thriving. While Sake may be the traditional Japanese alcoholic beverage most Izakaya's carry a variety of beer, wine and cocktails, whiskey is also a popular spirit there. Food is an equal accompaniment to the free flowing alcohol, many Izakaya's prefer larger shared plates that fit the communal shared nature of a traditional Izakaya. These pubs in Japan are often marked by a bright red chochin (lantern) like that depicted in the poster to the right. There is something beautifully quaint and romantic about the simple marker of a lantern to signify a warm place for food and drink.

In creating a beer for the Izakaya fest Gigantic owners/brewers Ben Love and Van Havig worked with local restaurant Shigezo. Sourcing enough Black Rice was somewhat difficult, only about 40 lbs were available at the local Asian grocery Uwajimaya and the remaining 44lbs were found at Gobuji in Beaverton.


Using a base of 85% Pilsner malt they left 15% of the mash for Black Rice that was prepared in huge cookers at Shigezo. "We had them leave the rice "as is" - not rinsing it, so that we got as much color and starch as possible," relates Brewmaster/Owner Ben Love. The cooked rice was added by the handful to the mash and stirred in. The enzymes of the mash worked their magic and extracted more sugar than thought from the rice resulting in a higher gravity than expected. "After the mash, the rice looked relatively the same, but when you ate it, it wasn't sweet. All the sugar was gone"

With just that 15% of the mash being black rice the wort picked up enough color to take on an orange-amber hue. Ben Love tells me that the Black Rice contributed an aroma similar to White Tea as well as a savory mushroom flavor and subtle black licorice-like spiciness.


Last week I joined brewers and volunteers to help slice around 1,260 pounds of Black Plums to be added to three 270 gallon wine totes and topped off with the beer which is how the beer earns it's unusual name "Ume Umai". Plums are a staple of Japanese culture and come in many varieties, "Ume" is the word used for plum and "Umi" means literally "yummy".The "Ume" is processed in different ways before eaten and is more tart than the western plum. The most popular plum dish is the "Umeboshi" a pickled plum typically enjoyed with cooked rice much like the ingredients of the beer. There is also "Umeshu" which is a sweet alcoholic plum wine.
Each Plum was hand sliced in half, the fruit brand sticker removed and then crushed by hand and tossed into the big plastic totes. We did not concern ourselves with the plum pit, that went in too. The black plum skin is tart, the inside sweet and modest crushing and slicing reveals a sweet meal for the still active eager yeast already pitched into the beer. Brewers hope that the dark skin of the fruit will contribute even more color to the finished ale and maybe even help it take on a purple tone.

When the founders of Valencia-based Influxis invested their last dollar into software to support their vision of allowing people to connect live on the Internet, little did they realize that within a decade Influxis would be named one of the top ?100 Companies that Matter Most in Online Video? by expert streaming-media judges for Streaming Media magazine.

The Santa Clarita company landed on a list of industry heavy-hitters such as Hulu, YouTube, Apple and Facebook.

Being selected means industry recognition, said Collin Lee, marketing director for Influxis. The online live-streaming company found itself on the list last year, and this year as well, he said.

?The judges go through a long list of companies and choose 100 of them that matter most in online video,? Lee said.

Not content to rest on its laurels, Influxis continues making advances as an interactive streaming solutions company to provide media server, network and services to companies who want to utilize the latest in streaming and live collaboration technologies. In October, the company made two moves to advance its capabilities even more.

Partnering with the maker of the software the founders spent their last dollar on when they launched their company, Influxis made an agreement with Adobe to take over the Adobe LiveCycle Collaboration Service, or LCCS, ? which will cease to exist at the end of the year, according to Lee. The software makes live streaming possible.

?We made an agreement with Adobe to take over their service,? he said. ?Influxis will be the only company supporting it. We put our own brand on it to provide customized streaming options and we provide our own expertise in supporting it. And we?ll still support Adobe?s LCCS customers.?

As a provider of real-time Web applications and online live collaboration tools, taking over LCCS was a natural fit for the company, said Richard Blakely, Influxis CEO and co-founder.

Influxis also partnered last month with Irvine-based Teradek, a company that manufactures hardware for wireless video products for filmmaking, live video production and broadcast media.

?It widens Influxis? capabilities,? Lee said. ?It allows customers to stream videos wirelessly or over cell networks to mobile devices or on their laptops.?

For the growing company with 30 employees, the overall strategy is to provide customers more comprehensive solutions, whether live or interactive, Lee said.

With the company?s new partnerships and also being recognized as one of the leading companies in online video, it?s been a busy last quarter, Blakely said.

?But I am even more excited about the products we will be launching next quarter, which will include major platform and infrastructure upgrades, WebRTC solutions and professional support for additional technologies,? Blakely said.

PCBUs, farms, quad bikes and safety ? a speculation ...

Soon another Australian State, South Australia, will be using the concept of the PCBU ? the Person Conducting a Business or Undertaking in its occupational health and safety laws. This concept has the potential to expand OHS laws well beyond the traditional factory fence or office and the recent discussion on the safety of quad bikes may illustrate this.

Until there are Court cases to clarify the Work Health and Safety laws and concepts it is worth looking at the source of these concepts. Safe Work Australia explains the PCBU in an interpretative guideline.

Businesses may be ?enterprises usually conducted with a view to making a profit and have a degree of organisation, system and continuity?. In terms of quad bike use, this could be a farm.

Undertakings ?may have elements of organisation, systems, and possibly continuity, but are usually not profit-making or commercial in nature.? Probably not a farm.

A workplace is likely to be ?a place where work is carried out for a business or undertaking and includes any place where a worker goes, or is likely to be, while at work.? This seems to include all of the farm boundaries and any travelling between the fields.

Safe Work Australia says that ?the definition of a ?worker? is a person who carries out work in any capacity for a person conducting a business or undertaking.? Significantly, there is no age reference in this so a child could be considered a worker if undertaking a work task like ?helping? on the farm.

Work is not defined in the laws but Safe Work Australia provides the following possible criteria for identifying work. Note that not all the criteria need to be present for work to exist.

?the activity involves physical or mental effort by a person or the application of particular skills for the benefit of another person or for themselves (if self-employed), whether or not for profit or payment;?

?activities for which the person or other people will ordinarily be paid by someone is likely to be considered to be work;?

?activities that are part of an ongoing process or project may all be work if some of the activities are for remuneration;?

?an activity may be more likely to be work where control is exercised over the person carrying out the activity by another person; and?

?formal, structured or complex arrangements may be more likely to be considered to be work than ad hoc or unorganised activities.?

It is not difficult to see the use of a quad bike on a farm reflecting one or more of these criteria.

But what OHS/WHS obligations exist for the PCBU? The PCBU must, according to advice from WorkCover NSW:

??must ensure the health and safety of workers, customers and visitors by eliminating or minimising risks at the workplace.?

On a farm where quad bikes are used this indicates a farmer needs to guarantee (?must?) the safety of themselves, their family and any visitors to the farm. That is an enormous expectation but is not really any different from the workplace duties that farmers have had to apply for decades except that the new laws overtly state that the safety obligation extends beyond the employee. Farmers are likely to need to either consider everyone who comes the farm and ?helps out? as employees or change their understanding of workplace safety to extend it throughout all parts of their farming business, whichever is the easier concept to understand.

SafetyAtWorkBlog is not a law firm and so this article is speculative but the information above may illustrate why the Workplace Relations Minister, Bill Shorten, does not need to make crush protection devices (CPDs) for quad bikes mandatory. The Work Health and Safety laws seem to place sufficient obligations on farmers, as PCBUs, that increasing the safety of quad bikes through a range of controls, including CPDs, is unavoidable.

Many have said that the WHS laws will need court cases and prosecutions to clarify situations where the laws apply. However this should not stop one from thinking about what may happen and what could apply. Indeed, the risk management obligations of the WHS laws may demand this speculative exercise in order to identify potential preventive actions, devices and systems.

For years it has been the case that if one wants to avoid an OHS prosecution, the best strategy is to prevent illness and injury. In this context how can one allow anyone on a farm to use a quad bike without a crush protection device, a helmet and adequate training? It is one thing to lose a relative to a quad bike rollover but it is another to be potentially prosecuted as well for a breach of work health and safety laws.

(AP) ? A JetBlue Airways captain who ran through the cabin of a cross-country flight yelling about religion and terrorists was prohibited Friday from flying or keeping his pilot's license, and now faces what could be the difficult task of finding work after being released from a prison medical facility.

Clayton Osbon was released more than seven months after a March flight from New York to Las Vegas during which passengers said the 49-year-old pilot left the cockpit and ran through the cabin yelling about Jesus and al-Qaida. The flight was diverted and safely landed in Amarillo, Texas.

Osbon was charged with interference with a flight crew. He was found not guilty by reason of insanity after a forensic neuropsychologist testified in a short, unpublicized trial that Osbon had a "brief psychotic disorder" brought on by lack of sleep. Reports on Osbon's psychiatric evaluations over the past several months have been sealed.

Osbon remains a JetBlue employee on inactive duty, but conditions set Friday by U.S. District Judge Mary Lou Robinson say he is not allowed on board any domestic or international flight without permission from the judge or his probation officer and he must forego his license. The conditions also say he must find regular work, unless his probation officer approves schooling or training instead.

Defense attorney Dean Roper said he did not know what sort of employment Osbon might pursue.

Osbon also is not allowed to communicate with anyone on the flight he disrupted and must participate in a treatment program for alcohol, drug and narcotic dependency, according to the judge's order.

"This is a bad situation for you and your family, but you are fortunate to have the type of immediate support that you have," said Robinson, who could have committed Osbon to a mental health facility.

Osbon appeared at his Friday hearing in a green jail jumpsuit and did not make an extended statement in court. Roper said afterward that he didn't know if Osbon would ever fly again, but was relieved the months-long legal proceeding was at an end.

"It's been a long ordeal for everyone involved, especially Mr. Osbon," Roper said.

Osbon left the federal courthouse without commenting to reporters and was to head back to his home in Georgia later in the day. Osbon and a JetBlue colleague who attended the hearing were making the 1,300-mile road trip together, Roper said.

JetBlue spokeswoman Sharon Jones declined Friday to say whether the judge's order would affect Osbon's status as employed but on inactive duty.

Osbon showed up unusually late for the March 27 flight. The plane was in midair when he told his first officer that they wouldn't make it to their destination, according to court documents.

He began to ramble about religion, scolded air traffic controllers to quiet down, then turned off the radios and dimmed the monitors in the cockpit. He said aloud that "things just don't matter" and encouraged his co-pilot to take a leap of faith.

When he left the cockpit, passengers moved to restrain him. A flight attendant's ribs were bruised in the scuffle, but no one was seriously injured.

At least 10 passengers have sued JetBlue over the episode.

Neuropsychologist Robert E.H. Johnson testified in July that Osbon's psychotic disorder at the time of flight lasted for about a week afterward, according to a hearing transcript. He determined Osbon suffered from a brief psychotic disorder and delusions "secondary to sleep deprivation." He didn't say how long Osbon had gone without sleeping before boarding the plane, and his psychiatric evaluation of Osbon has been sealed.

Those symptoms made Osbon incapable of understanding why his actions on the flight were wrong, Johnson testified.

After the July trial, Osbon was sent to a prison medical facility in North Carolina for evaluation. Robinson was to decide what happened next for Osbon in August, but instead extended his evaluation period into October after being notified that Osbon had suffered a psychotic episode in prison. She did not say what the nature of the episode was, if it was connected to his previous disorder or what prompted it.

Chrysler recalls about 745,000 Jeep SUVs in US

Chrysler Group LLC is recalling almost 745,000 Jeep sport utility vehicles in the United States to fix a part that could cause the airbags to inadvertently deploy.

Chrysler, controlled by Italy's Fiat SpA, is recalling 744,822 Jeep Grand Cherokee and Liberty SUVs from model years 2002 through 2004 because a part in the vehicles' airbag control module may fail, according to documents filed with the U.S. National Highway Traffic Safety Administration.

A failure of that module could cause the front airbags, side curtain airbags and seatbelt pretensioners to deploy inadvertently while the SUVs are being operated, increasing the risk of injury or accident, according to NHTSA documents.

In October 2011, NHTSA opened a preliminary investigation relating to complaints of inadvertent airbag deployments in Liberty SUVs, according to the documents. In January 2012, the probe was upgraded to an engineering analysis to include the Grand Cherokee SUVs.

The probe found 215 cases of inadvertent airbag deployments that resulted in 81 minor injuries involving both SUVs, according to the documents. There were no crashes found to have been caused by inadvertent airbag deployment.

Chrysler's dealers will install a supplemental jumper harness to the airbag control module at no cost to owners. The recall is expected to begin in January.?

6. Manage stress. Stress is a part of everyday life. Develop ways to help you cope and adjust to situations in your life that may cause you stress. The situation isn?t the problemits how you react to it.

7. Do things that improve your sense of well-being and your enthusiasm for life. Hobbies are a great way to do this. Look for laughter in all things.

8. Relationships. Keep strong connections with family and friends.

9. Don?t let fears and worries dominate your life. A worried mind is not at peace and robs you of zest and energy which you need to maintain youthfulness.

10. Drink green tea and anything with antioxidants. Antioxidants are in vegetables, fruits, and fish also. Your body produces its own antioxidants but as you age, that production drops which is why you should take antioxidant supplements.

Doing these ten things will help you live a healthier life and to age slower. Be wary of any products that claim to slow down or reverse aging. When in doubt, ask your doctor.

A great deal of stress can be eliminated by the simple strategy of self-acceptance.

I said simple. It may not necessarily be easy, especially if you have a long history of ?beating yourself up? or ?putting yourself down? emotionally.

Key for Success and Less Stress

Self-acceptance is a huge key for life success and is a gate-keeper for stress reduction. When you accept yourself as you are, you eliminate the inner conflict that fuels so much of your stress.

Three Ways to Practice Self-Acceptance

You can use one or more of these strategies, depending on what appeals to you.

1. Positive Self-Talk

Consistently employ positive self-talk or affirmations. Come up with a meaningful statement or two such as the examples below and repeat them several times a day for several months. Be patient while these statements filter into your unconscious mind and take root. You may well be challenged with feelings of self-judgment, but continue with your positive statements to gently reduce the stress of inner judgment and conflict.

Examples:

I love and accept myself just as I am.

I accept myself. I accept that I?m always doing the best I know how with what I know and what I have to work with.

I am willing to accept myself now.

I accept myself as a wonderful person, always willing to learn, grow and improve.

2. Positive Assumption

If there is some aspect of yourself that stresses you out, or that you have not accepted or simply can?t stand, experiment with this. (Try picking one of those qualities for which you beat yourself up!)

Assume that this negative part of your personality makes some positive contribution to your life. Somehow, some way, even if you can?t see it, this obnoxious or loathsome or whiney part of you is providing something useful or worthwhile to your process of learning and growing.

Imagine that you have access to the grand plan for your life, and imagine what positive experience this seemingly negative aspect is providing in that grand scheme of things. (Hint: It is often a major opportunity for learning and self-mastery!)

Assume that your imagination is correct and begin to appreciate this apparently negative part of you for its role in the grand plan of your life. Think of this part as a character, one part of your psychological make up. Thank it for assisting you to grow. Praise it for its persistence. Love it, just because it is a part of you! Work with this aspect of yourself for two minutes a day for several days, and repeat as necessary. In my experience and that of many clients, when you stop fighting the negative aspect and start embracing and accepting it as it is today, amazing transformations can take place.

3. Imagination at Depth

Imagine that you are fully accepted now by the one person from whom you most wish that acceptance. This could be a parent, spouse, partner, sibling, friend, teacher, etc. How do you know you are being fully accepted? What does that look like? What is being said? What are the feelings? Whatever you imagine receiving from this person that indicates acceptance, identify the qualities or characteristics involved and begin to give these qualities to yourself.

For instance, if you have longed for acceptance from your absent father, you might imagine reconnecting with him and sitting over a meal together sharing affectionate stories of the times you missed being together. You imagine finally feeling the depth of his love and acceptance just by being in his presence.

You might then explore how you can give yourself love and acceptance by being present with yourself. How can you spend more time getting acquainted with your own inner self? Nature walks? Meditation? Yoga? Journaling? A personal growth workshop? Counseling? Some artistic expression or creative hobby? How can you be there for yourself the way you would like your father to have been there for you? As you consistently practice these forms over the next few months, you will be creating a powerful foundation of self-acceptance.

That was why I got SO exited to see this commercial, that makes a B2B video fun, interesting and, heck even exciting!

So why does it work and how can you take these ideas and move them over to your small business?

The mystique of rail travel?okay, I have to admit that I love trains. I got it honestly from my dad who loves trains too. That having been said, there is a large percentage of the population who like trains, had toy trains or whose brothers, fathers or sons had trains. It pays to look at your industry and find out what makes it ?sexy? or interesting. Could be whacky urban myths, a rabidly loyal customer base or even the industry itself.

Obviously this was a professional production, CGI laden, EXPENSIVE commercial that ran on the national cable channels. So how can you expect to compete (and darn it, you keep telling us that great production on videos is not important!) Take the idea of the video and transport it to your less expensive videos!

I could so picture this as a smaller local video with pictures of trains fading into a video of a train blowing past and then a picture of a big city in the background with the words superimposed over the images. That is a perfectly acceptable version that would work for our small biz peeps. You just need to make an effort to think how you can leverage these kinds of ads and make them your own.

Copy the big guys

I cannot express this enough. BIG NATIONAL companies spend a gagillion dollars doing ads, focus testing them, production costs, etc. If you can take their concepts and make them your own, you are WAY ahead of your local competition. Using a national ad that comes to mind, how fun would it be to take the Farmers ad with Kasey Kane (a Nascar race car driver) and a fire extinguisher and move it down to small business level by going with a local agent and a Boy Scout style racer.

B2B YouTube video marketing does not have to be boring or hard, it just takes a little bit of creativity!

Everything you wanted to know about voting machines

Ever since punch-card voting machines produced the "hanging chads" that led to the Florida recount in the 2000 election, Americans have been looking for new and more reliable technology to use on Election Day.

One result: The Help America Vote Act of 2002, which authorized $3.9 billion in federal funds for trading in punch-card and lever systems with either e-voting or optical scan systems. The act also stipulates that all polling places should make available a handicap-accessible voting device.

But while the country, for the most part, has moved on from the older, more unreliable machines, the new models present their own set of challenges.?From shadowy conspiracy theories to genuine concerns about glitches, here's what you need to know about the machines that are supposed to make democracy work.

What kind of machines are used, and where?

Sixty percent of the country now supplies voters with optical scanners. To use them,?voters shade in their choices on paper ballots (similar to how they would take an SAT test) before feeding it to the machines. These optical scanners, while not exactly a brand new technology, are the state of the art for both their accuracy in processing votes and their security against tampering.

But the same cannot always be said for the alternative, e-voting equipment (Direct-Recording-Electronic machines, or DREs), which is used in about 25 percent of the country. These are lined up in places like Georgia, Maryland, Utah, Nevada, New Jersey, Pennsylvania, Indiana and Texas.

E-voting machines come in three variants: push-button machines sporting a keypad; LCD touch-screens; and machines that use a rolling wheel to select and confirm a vote onscreen. All of these register votes on an electronic ballot. The absence of a paper trail, which is preserved by the optical scanners, has caused concerns since their inception.

VerifiedVoting.org provides more specifics on the history and different forms of voting technology, including a map showing different states' brand of election equipment.

Does anyone still use punch-card or lever systems?

Four counties in Idaho still use punch-card ballots, while none in the country have used lever machines since 2010.

What are some of the examples of problems with e-voting machines?

In 2004, electronic votes were wiped from machines in New Jersey and North Carolina. But the much more ominous worries over the limits and liabilities of e-voting became clear in 2008, when a study by Princeton University revealed how easy it would be to hack into the Sequoia brand of e-voting machines (used chiefly in New Jersey, Pennsylvania and Louisiana) to steal votes.

More disturbing is this quote from Roger Johnston, a computer science expert leading a subsequent test on Diebold AccuVote e-voting machines just last year: "I've seen high-school science fair projects that are more sophisticated than what is needed to hijack a voting machine." His crash course in vote-jacking went as follows: the equipment was hacked by inserting a very inexpensive homemade device into the voting machine, which could be remotely controlled from afar. In practice, when the voter attempted to mark her e-ballot, the hacker could intercept and alter the vote from one party to the other.

Despite these widely reported studies, as well as HBO's 2006 documentary "Hacking Democracy," there has not yet been any effort to address these sorts of problems with the Diebold machines, or the smaller malfunctions of e-voting machines more broadly. (It is of course also true that there have been problems with fraud and machine error with more traditional forms of voting technology.)

The software for the e-voting machines is proprietary, which means that only the companies that manufacture them have access to their design, which they have kept from examination through extended legal battles.

What's with stories about Tagg Romney owning voting machines?

In a tight election, even the most tenuous connections can be spun quickly into a web of conspiracy. That's not to say that there aren't genuine links between very enthusiastic Mitt Romney donors and Hart InterCivic, a large supplier of voting machines in Ohio?but the theories attempting to prove that Tagg Romney, the Republican nominee's eldest son, owns Ohio voting machines overstep the boundaries of available evidence.

As Rick Ungar reported in Forbes, two Hart InterCivic board members made direct donations to the Romney campaign; furthermore, several directors of H.I.G. capital, which owns Hart, are major money-raisers for the campaign. (Some of them were in the room during Romney's infamous "47 percent" remarks.)

But there is no evidence that Tagg Romney's private equity firm, Solamere Capital, invests, owns or controls voting machines made by InterCivic. The closest one gets by following the money is to find Solamere investing in H.I.G.'s medical fund, BioVentures, a wholly separate fund, as reported by Eugene Kiely and Lucas Isakowitz at Factcheck.org.

What will superstorm Sandy's impact be on voting in the Northeast?

In the back of people's minds, Sandy's effect on voting in the Northeast have been a quiet but pressing concern. As Thad Hall, a University of Utah political scientist and researcher for the Voting Technology Project, told the AFP, "Some voters will literally not be able to vote because they will have been evacuated from their local polling place and there is no provision for remote voting."

The voting machines themselves will be left operating on batteries, not an encouraging prospect as Election Day drags on longer in areas where debris and destruction have complicated the process and organization.

In New Jersey, the state is allowing residents to combat the aftermath of the storm by voting through absentee ballots?by email or fax. And state officials in New York have said that residents may be granted an extra day to vote if Tuesday's turnout is below 25 percent.

(AP) ? Sharon Osbourne says she had a double mastectomy after learning she carries a gene that increases the risk of developing breast cancer.

Osbourne told Hello! magazine that "I didn't want to live the rest of my life with that shadow hanging over me."

The 60-year-old "America's Got Talent" judge, who had colon cancer a decade ago, said that without the surgery, "the odds are not in my favor."

She added: "It's not 'pity me,' it's a decision I made that's got rid of this weight that I was carrying around."

The magazine went on sale Monday.

Osbourne, husband Ozzy and children Jack and Kelly became rock's most famous clan thanks to reality show "The Osbournes" a decade ago.

Jack Osbourne, 26, was recently diagnosed with multiple sclerosis.

Scientists monitor comet breakup

ScienceDaily (Nov. 4, 2012) ? The Hergenrother comet is currently traversing the inner-solar system. Amateur and professional astronomers alike have been following the icy-dirt ball over the past several weeks as it has been generating a series of impressive outbursts of cometary-dust material. Now comes word that the comet's nucleus has taken the next step in its fragmentation.

"Comet Hergenrother is splitting apart," said Rachel Stevenson, a post-doctoral fellow working at NASA's Jet Propulsion Laboratory in Pasadena, Calif. "Using the National Optical Astronomy Observatory's Gemini North Telescope on top of Mauna Kea, Hawaii, we have resolved that the nucleus of the comet has separated into at least four distinct pieces resulting in a large increase in dust material in its coma."

With more material to reflect the sun's rays, the comet's coma has brightened considerably.

"The comet fragments are considerably fainter than the nucleus," said James Bauer, the deputy principal investigator for NASA's NEOWISE mission, from the California Institute of Technology. "This is suggestive of chunks of material being ejected from the surface."

The comet's fragmentation event was initially detected on Oct. 26 by a team of astronomers from the Remanzacco Observatory, using the Faulkes Telescope North in Haleakala, Hawaii. The initial fragment was also imaged by the WIYN telescope group at Kitt Peak National Observatory in Arizona.

For those interested in viewing Hergenrother, with a larger-sized telescope and a dark sky, the comet can be seen in between the constellations of Andromeda and Lacerta.

The orbit of comet 168P/Hergenrother comet is well understood. The comet, nor any of its fragments, are a threat to Earth.

As obvious of a winner as the Tennessee offense was, the Tennessee defense is an even more obvious loser.

Let's look at the numbers: 721 yards allowed, 496 passing yards allowed, 225 rushing yards allowed, no sacks, no turnovers forced and 48 points.

Had Tennessee given up those numbers to Oregon, it might be somewhat understood?but to give that up to a team from the Sun Belt, that's inexcusable.

This defense is the worst Tennessee fans have ever seen, and I'm not sure there's a fix for the final three games of the season. Fans better pray the offense continues to roll.

Here's How Israel Thinks It Could Attack Iran ... - Business Insider

Israeli military leaders have conducted a war game simulating a strike on Iranian nuclear facilities, three days after the US Presidential elections. They concluded such an operation could be pulled off without plunging the whole region into war. Iranian experts disagree. David Patrikarakos reports.

On the 24 September at Israel?s National Institute of Security Studies, an obdurately dull building off a main road in Tel Aviv, three dozen men and women drawn from the top echelons of Israel?s political and military elite met to play a war-game, the outcome of which could help decide whether Israel goes to war with Iran.

I was in Israel with film director, Kevin Sim, who was making a documentary on the war game for ?Dispatches? on Channel 4.

The notional starting point of the game was 9 November 2012, just after the American presidential elections. Participants were divided into ten groups each representing likely key players in the conflict ? Israel, Iran, the US, Russia, Hezbollah, Egypt, Syria, Turkey, Russia and the UN. All the teams were made up of Israelis.

The war game is what it says it is ? a game. Despite its seriousness, inside the Institute there was an air of make-believe.

The ?Netanyahu? who led the Israeli team was an imposter ? a former Deputy Foreign Minister of Israel. Two former government ministers took turns to play Obama. Putin was a former Israeli ambassador to Moscow.

The war game was designed to explore the likely outcome of an Israeli pre-emptive attack on Iran; it didn't examine the legal or moral arguments for or against any such strike but rather focused on how the Iranians might retaliate and what the wider fallout would be.

The game began when the players were told that just after midnight, in a surprise air raid, Israeli bombers had attacked nuclear installations deep inside Iran. First reports indicated that Israel had acted alone without consent or help from the Americans.

The Iranians responded quickly to the Israeli strike, launching a barrage of Shahab-3 ballistic missiles (based on the North Korean Nodong-1 missile) at Israeli targets, including the country?s largest city, Tel Aviv. Then they discussed their political goals.

The most immediate of these was the desire to rebuild the nuclear programme, preferably to a level ?beyond what it was on the eve of the strike.? Given their newfound status as victims of an attack, another priority was to have the sanctions on Iran lifted; and to have sanctions placed on Israel for its ?unprovoked act.?

They also decided to offer Jordan and Egypt extensive aid packages to cancel their peace treaties with Israel, before debating a key dilemma: whether or not to attack US targets. With Iran?s considerable influence in Iraq and Afghanistan, not to mention its huge presence in the Gulf, the Iranians could cause huge problems for Washington.

In the end, though, the decision was taken to refrain; Washington was one more complication they didn't need. Russia (which has been building the Bushehr nuclear power plant) was also approached for immediate help to rebuild the devastated facilities, as well as delivery of S-300 surface-to-air missiles and a consignment of Sukhoi 24 aircraft.

Militarily, Iran tried to get its allies ? namely, its proxy militia groups Hezbollah in Lebanon and Hamas in Gaza ? to enter the conflict on its behalf.

"All our help to you over the years," the Israeli playing Ahmadinejad (a former colonel in military intelligence) declared in a meeting with Hezbollah, "has been for the purpose of this moment."

"There?s no such thing as a free lunch," his assistant added. The Lebanese declared they were only too happy to help - in any way that would not bring massive Israeli retaliation down on Lebanon. There was tension in the room.

The Israelis, meanwhile, had met with the ?US President? (the Israelis deliberately made no comment on who had won the 7 November US Presidential election), who, despite being unhappy at the lack of a ?timely announcement? about the ?premature? strike, reiterated his support for Israel. Washington?s primary concern, it seemed, was to avoid an escalation of hostilities in what it considered to be the world?s most volatile region. It raised the status of alert for its forces across the Middle East.

The Israelis were clear on what they wanted from their US ally. Most important was for Washington to use its ?good offices? in Lebanon and Gaza to prevent Hezbollah and Hamas inflaming the situation. The Israelis also wanted US ships in the area, armed with Aegis anti-missile systems, to help intercept the Iranian missiles raining down on them.

Finally, they requested that the US maintain pressure on Iran in the UN Security Council, and to help ensure that Israel was not the victim of ?one sided resolutions in the United Nations."

On the ground, things were tense. As Iran continued shelling Israel, people began to leave Tel Aviv heading to the South. Fearing Israeli retaliation, Hezbollah limited themselves to firing only a few, sporadic Katyusha rockets into northern Israel in an attempt to placate their Iranian patron, and succeeded in pushing the inhabitants of the city of Kiryat Shmona into heading south as well. Israel, in turn, instructed its army not to respond to the firing from Lebanon without the Minister of Defense?s authorization; army reserves were called up.

But the Israelis were also planning ? for a second wave of strikes against Iran?s uranium enrichment facilities, which they undertook about 24 hours (in game time) after the first. This second strike seemed to encapsulate the war game for Israel. Its boldness rewarded and Iran simply unable to respond in kind: limited to firing missiles at Israel, many of which were intercepted - largely by itself.

By the game?s end, Iran?s nuclear facilities had been almost totally destroyed. Hezbollah and Hamas had done nothing more than launch a few token rocket salvos at Israel, while Iranian missiles had been of only limited effect. Iran had also failed in its attempts to have the sanctions on it removed and, thanks to US cover in the UN Security Council, it had also failed to have sanctions placed on Israel. It was the game?s clear loser.

Yehuda Ben-Meir, the former deputy foreign minister of Israel, who had played Netanyahu, summed the situation up. ?The principal insight we gained was that following an Israeli attack the entire world was interested in calming the region down.

"Before the attack everyone had something to say on a possible attack but once it became a fait accompli the world wanted to know what would happen next, and everyone?s goal was to contain the situation and to prevent escalation.?

I had seen Israel?s perspective on a possible attack and now wanted an Iranian view, so I caught a flight to Istanbul to put the game?s results to Hossein Mousavian, a former member of Iran?s nuclear negotiating team. He believed the game was deeply flawed.

Dismissing the limited nature of Iran?s response, Mousavian argued that in reality Iran would respond ?by all means?, employing the total power of its armed forces to draw Israel into a long-term war. Perhaps, more importantly, Mousavian argued that Iran would see the US as complicit.

Iranians, he said, are convinced that Israel is too small to attack Iran unilaterally Iran. "They see Israeli as just a baby,? he said. ?One that would never act without US assistance.?

The attack would also have huge regional consequences, he continued. Most obviously, Iran would use its status as the symbol of resistance against Israel in the Middle East to stoke the high levels of anti-Americanism that already exist there. Even groups like Al Qaeda, he argued, who are Iran?s enemies, would use ?inflamed Muslim sentiment to launch attacks at American citizens across the world and on US soldiers on the many American bases in the region.?

At the end of our interview, he leaned forward, took my arm and looked me right in the eyes. He recalled the Israeli strikes on an Iraqi nuclear reactor in 1981 and a Syrian reactor in 2007.

?This is the big mistake that people make,? he told me. ?To think if Israel attacks Iran, like it attacked Iraq and Syria, the Iranians would not retaliate.

"The nation is one hundred percent different. The whole region would be engulfed.?
