Gay marriage opponents ask court to intervene

SAN FRANCISCO (AP) ? A wave of weddings were performed in San Francisco City Hall on the heels of the U.S. Supreme Court's historic decisions to restore same-sex marriages to California, as defeated backers of the state's gay marriage ban filed a last-ditch effort to halt the ceremonies.

Less than 24 hours after California started issuing marriage licenses to same sex couples, lawyers for the Arizona-based Alliance Defending Freedom filed an emergency petition to the high court Saturday asking it to halt the weddings on the grounds that its decision was not yet legally final. They claimed the 9th U.S. Circuit Court of Appeals acted prematurely and unfairly on Friday when it allowed gay marriage to resume by lifting a hold that had been placed on same sex unions.

The motion was filed as dozens of couples in jeans, shorts, white dresses and the occasional military uniform filled City Hall to obtain marriage licenses. On Friday, 81 same sex couples received marriage licenses.

Although a few clerk's offices around the state stayed open late on Friday, San Francisco, which is holding its annual gay pride celebration this weekend, was the only jurisdiction to hold weekend hours so that same sex couples could take advantage of their newly restored right, Clerk Karen Hong said.

A sign posted on the door of the office where a long line of couples waited to fill out applications listed the price for a license, a ceremony or both above the words "Equality=Priceless."

"We really wanted to make this happen," Hong said, adding that her whole staff and a group of volunteers came into work without having to be asked. "It's spontaneous, which is great in its own way."

The timing couldn't have been better for California National Guard Capt. Michael Potoczniak, 38, and his partner of 10 years, Todd Saunders, 47, of El Cerrito.

Potoczniak, who joined the Guard after the military's ban on openly gay service was repealed almost two years ago, was scheduled to fly out Sunday night for a month of basic training in Texas.

"I woke up this morning, shook him awake and said, 'Let's go,'" said Potoczniak, who chose to get married in his Army uniform. "It's something that people need to see because everyone is so used to uniforms at military weddings."

Also waiting to wed Saturday were Scott Kehoe, 34, and his fiance, Aurelien Bricker, 24. After finding out on Facebook that the city was issuing same sex marriage licenses Friday, the San Francisco couple rushed out to Tiffany's to buy wedding rings.

"We were afraid of further legal challenges in the state," Kehoe said.

The Supreme Court ruled on Wednesday that Proposition 8's backers lacked standing to defend the 2008 law because California's governor and attorney general have declined to defend the ban.

Then on Friday, the 9th Circuit appeared to have removed the last obstacle to making same sex matrimony legal again in California when it removed its hold on a lower court's 2010 order directing state officials to stop enforcing the ban.

Within hours, same sex couples were seeking marriage licenses. The two couples who sued to overturn Proposition 8 were wed in San Francisco and Los Angeles Friday.

Alliance Defending Freedom Senior Counsel Austin Nimocks said on Saturday that the high court's consideration of the case isn't done because his clients still have 22 days to ask the justices to reconsider Wednesday's 5-4 decision.

Under Supreme Court rules, the losing side in a legal dispute has 25 days to request a rehearing. While such requests are almost never granted, the high court said that it wouldn't finalize its judgment in the case at least until after that waiting period elapsed.

The San Francisco-based appeals court had said when it imposed the stay that it would remain in place until the Supreme Court issued its final disposition, according to Nimocks.

"Everyone on all sides of the marriage debate should agree that the legal process must be followed," he said. "On Friday, the 9th Circuit acted contrary to its own order without explanation."

Many legal experts who had anticipated such a last-ditch effort by gay marriage opponents said it was unlikely to succeed because the 9th Circuit has independent authority over its own orders ? in this case, its 2010 stay.

While the ban's backers can still ask the Supreme Court for a rehearing, the 25-day waiting period is not binding on lower federal courts, Vikram Amar, a constitutional law professor with the University of California, Davis law school, said.

"As a matter of practice, most lower federal courts wait to act," Amar said. "But there is nothing that limits them from acting sooner. It was within the 9th Circuit's power to do what it did."

The city, home to both a federal trial court that struck down Proposition 8 as unconstitutional and the 9th Circuit, has been the epicenter of the state's gay marriage movement since then-Mayor Gavin Newsom ordered his administration in February 2004 to issue licenses to gay couples in defiance of state law.

A little more than four years later, the California Supreme Court, which is also based in San Francisco, struck down the state's one-man, one-woman marriage laws.

City Hall was the scene of many more marriages in the 4 1/2 months before a coalition of religious conservative groups successfully campaigned for the November 2008 passage of Proposition 8, which amended the state constitution to outlaw same sex marriages.

Mobile virtualization startup BlueStacks only recently revealed the GamePop, its mobile home gaming console ?that offers all-you-can play gaming for a flat monthly fee, but it?s already expanding the line. Today, the company is announcing GamePop Mini, a version of the GamePop that offers completely free hardware with a standard $6.99 monthly GamePop service subscription, with smaller hardware that?s yours to keep after 12 months even if you decide to cancel your GamePop account.

The GamePop Mini also runs Jelly Bean 4.2, and connects to your TV via an?included?HDMI cable. Just like its big brother the GamePop, it will provide access to the service?s curated list of 500 games (from both Android and iOS sources) each month, with titles from studios like HalfBrick (makers of Fruit Ninja and Jetpack Joyride) that are normally available only with a one-off purchase. The key difference between the GamePop and the GamePop Mini will be in terms of specs, which BlueStacks aren?t quite ready to reveal.

Once that happens, the value prospect of a subscription service with true portability increases dramatically; GamePop truly does become the Netflix of mobile gaming.

?It is in part to show how good the market is out there, and I would call it a showcase, but the pre-orders have also inundated us,? Sharma said. ?So it?s not just a showcase. The direct channel is a very strong business, and one we plan to continue, but having it run everywhere is our vision.?

Sharma also talked about GamePop?s potential to eventually bring in media titles, as well as interactive experiences that aren?t strictly games, like the Talking Tom series, which is especially a hit with younger audiences. For mobile developers, that presents an option for getting a variety of mobile titles in front of a wide swath of users on a huge range of devices, on a subscription-based billing model that could upturn the pay-per-download revenue scheme that?s mostly driven the mobile software ecosystem to date.

GamePop Mini will be a way for BlueStacks to spread its service far and wide, especially since there?s no commitment, and you need only return the console hardware should you decide to cancel the subscription before the 12 month mark. It?s also super portable, and in fact pocketable, so it?s designed to travel (which has the side benefit of introducing new people to GamePop). Rival demonstrators mass in Egypt after deadly clash | Morocco ...

CAIRO, June 28, 2013 (AFP)

Supporters and opponents of Egypt?s Islamist President Mohamed Morsi gathered for rival demonstrations on Friday, raising fears of fresh violence after one activist was killed overnight.

Supporters of the Muslim Brotherhood and its Islamist allies massed outside the Rabaa al-Adawiya mosque in Cairo?s Nasr district to demonstrate their backing for Morsi in his rejection of opposition calls to step down just a year into his term of office.

They gathered under the slogan ?legitimacy is a red line?, in reference to Morsi?s insistence that he won a free and fair election and has a popular mandate.

Opponents of the Islamist president gathered outside Cairo?s Al-Azhar ? Sunni Islam?s highest seat of learning ? for a march to Tahrir Square, the iconic epicentre of the protest movement that ousted veteran strongman Hosni Mubarak in 2011.

Hundreds of Morsi opponents have been holding a sit-in in Tahrir since Tuesday.

Their protest was called by the Tamarod movement (Arabic for rebellion) which says it has collected more than 15 million signatures to a petition demanding Morsi?s resignation and a snap election.

The mainly secular opposition charges that the president has reneged on his promise to rule for all Egyptians and has failed to deliver on the uprising?s aspirations for freedom and social justice.

The overnight violence erupted in the eastern part of the Nile Delta, north of the capital, Morsi?s own home province.

Rival demonstrators clashed outside offices of the Muslim Brotherhood?s political arm, the Freedom and Justice Party, on whose platform the president won last year?s election.

The FJP said on its website that one of its supporters was killed. Thirty people were also wounded, the health ministry said.

Germany warned that Egypt faced a ?moment of truth? for its fledgling democracy and urged the Islamist president to implement reforms.

Foreign Minister Guido Westerwelle said that demonstrators had a right to peaceful assembly but urged both sides to refrain from bloodshed.

Westerwelle ?is deeply concerned about the current escalation in political tensions in Egypt,? his spokesman Andreas Peschke told reporters.

?This is in his view a key moment of truth for political change in Egypt.?

Morsi himself warned in a televised speech on Wednesday that the growing polarisation between his fans and foes threatens to ?paralyse? the country.

He pledged to consider constitutional reforms and appealed to the opposition to join talks.

It was his latest attempt to strike up a dialogue between political factions in a country deeply split between his Islamist allies and an opposition of leftists, liberals, Christians and some Muslim groups.

But late on Thursday, the opposition National Salvation Front coalition rejected his offer of talks and renewed its call for a snap election to replace him.

Since taking office a year ago, Morsi has squared off against the judiciary, media, police and even artists.

However, he has admitted to failings and has vowed to correct them.

?I have made many mistakes, there is no question. Mistakes can happen, but they need to be corrected,? he said.

He warned the media against abusing the freedoms they won from the 2011 uprising.

Judges imposed a ban on foreign travel on Thursday on the owner of a private television channel that hosts a popular satire show.

CBC owner Mohammed al-Amin faces charges of tax evasion, and Morsi singled him out by name in Wednesday?s speech.

The army, which oversaw the transition from Mubarak?s autocratic rule but has been on the sidelines since Morsi?s election, warned it would intervene if violence breaks out.

It has brought in reinforcements to key cities, security officials said.

In Cairo, residents were withdrawing cash and stocking up on food, and many companies have said they will close on Sunday, the first day of the working week in Egypt.

Fuel shortages have seen drivers queueing outside petrol stations through the night, bringing parts of the capital to a standstill.

Mass cremations of victims were taking place in India's flood-ravaged state of Uttarakhand even as rescue operations to evacuate stranded people entered their last phase. More than 840 people died in flashfloods and landslides in the mountainous state from June 15 to 16.

NEW DELHI ? India began the mass cremation of bodies recovered after devastating floods in the country's northern Himalayan region, government officials said on Thursday, adding that hundreds of people were still missing.

The floods, triggered by heavier than normal and early monsoon rains, have killed at least 822 people and displaced tens of thousands of inhabitants in Uttarakhand state, a popular destination for Hindu pilgrims due to its shrines and temples.

The disaster has been dubbed a "Himalayan tsunami" by the media due to the torrents of water unleashed in the hilly region, which sent mud and boulders crashing down, burying homes, sweeping away buildings, roads and bridges.

Eighteen bodies were cremated on Wednesday in the temple town of Kedarnath ? one of the worst affected areas ? and at least 40 would be cremated on Thursday, said a government doctor in Guptkashi, some 25 miles from Kedarnath.

Media reports said 600 bodies have been recovered from the site of Kedarnath alone, but government officials could not confirm this.

"Three of our doctors are currently in Kedarnath and they are trying to help identify bodies which have been found in the area," said Sunil Kumar Verma, one of a team of nine doctors from the Uttarakhand health department.

Verma said Kedarnath was only accessible by helicopter.

The disposal of corpses is important to eliminate the risk of contaminating the water supply and outbreaks of diseases such as diarrhea and cholera.

An air force spokesman said helicopters had been dropping items such as wood and clarified butter - essential materials for Hindus to conduct their last rites.

Heavy rains over the last three days have hampered rescue operations by the army and air force who have been evacuating survivors marooned in and around the four temple towns of Kedarnath, Badrinath, Gangotri and Yamunotri since June 15.

Around 96,500 people have so far been evacuated by land and air, said media reports. Television channels have been broadcasting dramatic pictures of desperate pilgrims scrambling to get aboard helicopters.

Government officials said around 350 people had been reported missing, but added that it was likely that there were many more.

"It's very difficult to know the real figures and the scale of the disaster at the moment as many places are still blocked and we are still struggling to get to all the affected areas," said an official with the National Disaster Management Authority.

Federer, Sharapova lose in wild day at Wimbledon

LONDON (AP) ? The day began, oddly enough, with word that Roger Federer's orange-soled shoes did not conform to Wimbledon's all-white dress code and would need to be replaced.

It ended, shockingly enough, with Federer losing in the second round at the All England Club, his earliest Grand Slam exit in a decade. It ended his record streak of reaching at least the quarterfinals in 36 consecutive major tournaments.

And in between? Oh, there was so much more to this unpredictable Wednesday, including four-time major champion Maria Sharapova's loss to a qualifier, and the injuries that forced seven players to leave because of withdrawals or mid-match retirements, believed to be the most in a single day at a Grand Slam tournament in the 45-year Open era.

In that group: second-seeded Victoria Azarenka; sixth-seeded Jo-Wilfried Tsonga; Steve Darcis, the man who stunned 12-time major champion Rafael Nadal in the first round; and 18th-seeded John Isner, who will forever be remembered for winning a 70-68 fifth set in the longest match ever, more than 11 hours. This time, Isner lasted all of 15 minutes, stopping in the third game after hurting his left knee.

Federer, Sharapova and Azarenka were three of seven players who have been ranked No. 1 that departed in a span of about 8? hours. They also were among 12 seeded players heading home.

Most remarkable of all, of course, was Federer's 6-7 (5), 7-6 (5), 7-5, 7-6 (5) loss to 116th-ranked Sergiy Stakhovsky in the day's last match on Centre Court. Federer hadn't been beaten this early at a Grand Slam tournament since the first round of the French Open on May 26, 2003, back before he owned a single trophy from any of the sport's most important sites.

Now his collection is 17 total, with seven from Wimbledon, including last year's.

"This is a setback, a disappointment, whatever you want to call it," Federer said. "Got to get over this one. Some haven't hurt this much, that's for sure."

In addition to the hard-to-believe results and the slew of injuries, there was all manner of sliding and tumbling on the revered grass courts, prompting questions about whether something made them more slippery.

"Very black day," summed up 10th-seeded Marin Cilic, who said a bad left knee forced him to pull out of his match.

One had to wonder what Thursday might bring. The Day 4 schedule featured defending champion Serena Williams, who took a 32-match winning streak into the second round against Caroline Garcia; last year's runner-up, No. 4 Agnieszka Radwanska; 2011 Wimbledon winner Novak Djokovic; and 2009 U.S. Open champion Juan Martin del Potro.

They were to take the court knowing that after three days of the two-week tournament ? merely halfway through the second round ? a total of five of the 10 highest-seeded women were gone, along with four of the top 10 men.

"Bizarre," said 17th-seeded Sloane Stephens of the U.S., who stuck around by winning her match 8-6 in the third set. "I don't know what's going on."

No one did.

One hypothesis making the rounds: The grass is different because there is a new head groundsman at the All England Club, Neil Stubley (keep in mind, though, that he's been helping prepare the courts here for more than 15 years, albeit with a less distinguished title).

Another popular idea was that the recent weather ? it's been in the 60s and humid, but without a drop of rain so far ? is affecting traction.

"I don't know if it's the court or the weather. I can't figure it out," said two-time Australian Open champion Azarenka, who said she bruised a bone in her right leg when she slipped on the turf in her victory Monday and couldn't face Flavia Pennetta on Wednesday. "It would be great if the club or somebody who takes care of the court just would examine or try to find an issue so that wouldn't happen."

Sharapova managed to finish her match, at least, despite losing her footing a few times, but told the chair umpire the conditions were dangerous.

"After I buckled my knee three times, that's obviously my first reaction. And because I've just never fallen that many times in a match before," said the four-time major champion, noting that she thought she might have strained a muscle in her left hip.

"I just noticed a few more players falling a bit more than usual," Sharapova added.

The All England Club took the unusual step of issuing a statement in response to Wednesday's events ? and complaints.

"There has been some suggestion that the court surface is to blame. We have no reason to think this is the case. Indeed, many players have complimented us on the very good condition of the courts," the statement read. "The court preparation has been to exactly the same meticulous standard as in previous years and it is well known that grass surfaces tend to be more lush at the start of an event. The factual evidence, which is independently checked, is that the courts are almost identical to last year, as dry and firm as they should be, and we expect them to continue to play to their usual high quality."

Hours earlier, the club confirmed it had reminded Federer ? and other players ? that rules are rules, so the neon bottoms of his sneakers simply would not be tolerated. He complied, wearing white soles Wednesday, at the tournament only two other men have won as many as seven times (Willie Renshaw, whose titles came in the 1880s, and Pete Sampras).

"Beating Roger here on his court, where he's a legend, is, I think, having definitely a special place in my career," Stakhovsky said.

That's something of an understatement.

Stakhovsky owns a losing record for his career (108-121) and at Grand Slams (12-18) and never has been past the third round at a major tournament. Until Wednesday, he was best known, if at all, for grabbing his cellphone to take a photo of a disputed ball mark in the clay during a first-round loss at the French Open last month.

Federer's consistent brilliance extends beyond Wimbledon, of course: He reached 23 Grand Slam semifinals in a row in one stretch, which also included 10 straight finals.

Not since a third-round loss at the 2004 French Open had Federer failed to reach the quarterfinals at a Grand Slam. That means he'd won 141 consecutive matches in the first through fourth rounds at the Australian Open, French Open, Wimbledon and the U.S. Open (he advanced four times via an opponent's withdrawal).

On Wednesday, though, the third-seeded Federer simply was unable to derail Stakhovsky's serve-and-volley style, breaking the 27-year-old Ukrainian only once.

Still, there actually was a real chance for Federer to get back in the thick of things. Ahead 6-5 in the fourth, he held a set point as Stakhovsky served at 30-40. But Stakhovsky came up with this sequence: volley winner, 111 mph ace, serve-and-volley winner.

"I had my opportunities, had the foot in the door. When I had the chance, I couldn't do it," said Federer, who is 122-18 on grass over his career, while Stakhovsky is 13-12. "It's very frustrating, very disappointing. I'm going to accept it and move forward from here. I have no choice."

In the closing tiebreaker, with spectators roaring after every point, Stakhovsky raced to a 5-2 lead, and the match ended with Federer pushing a backhand wide on a 13-stroke exchange. Stakhovsky dropped to his back, then later bowed to the stadium's four sides. He sat in his sideline chair, purple Wimbledon towel draped over his head, as Federer quickly headed for the locker room. Stakhovsky peeked out and saw Federer leaving, then applauded right along with the fans' standing ovation.

"You're playing the guy and then you're playing his legend," Stakhovsky said. "You're playing two of them. When you're beating one, you still have the other one who is pressing you. You're saying, 'Am I about to beat him? Is it possible?'"

On this wildest of days, it was.

The Wall Street Journal has issued a large report today that details several new hardware products that Google has in the pipeline. According to the report, Google?s latest hardware efforts are being developed in order to match rumored upcoming hardware offerings from Apple (like new entries into the TV and wearable computing spaces). Some future Google hardware, according to the report, includes:

Also in the cards is a next-generation of the Android OS that is designed to appeal to low-cost devices for emerging markets. As for Apple, the Cupertino-based company is shipping a redesigned iOS 7 this fall and is also rumored to be working on a lower-cost iPhone. The WSJ report also notes that this new version of Android could appear in new devices like notebook computers and home appliances such as refrigerators. Google is said to also be working on various other hardware, though this will be separate from the Google-owned Motorola Mobility.

Anti-surveillance hero Edward Snowden ironically wants to take shelter in a country with a terrible surveillance record: Ecuador.

The 30-year-old former Booz Allen contractor, thought to be in Moscow after leaking top secret documents on domestic spying conducted by the NSA, has petitioned for asylum in the South American country that also sheltered Wikileaks founder Julian Assange.

Secret documents obtained by Rosie Gray at BuzzFeed indicate Ecuador has a record of spying on social media, targeting of political opponents and journalists, and innovation in facial recognition, as well as the recent purchase of?a "GSM Interceptor" by SENAIN, Ecuador's intelligence service.

Gray writes:

In a letter to Pablo Romero last year in June, a Smart Solutions representative named Gabriel Guecelevich touted the capabilities of the GSM system, promising the ability to ?copy SIM cards, identify phone calls, route phone calls to different places, intercept text messages, falsify and modify the text messages, keep messages in their system, disconnect calls, block phone calls, system should be able to intercept a minimum of 4 phone calls simultaneously.?

Guecelevich also specified that the GSM system, which has previously been mentioned in WikiLeaks files as a spy tool, can be used from a car that is 250 meters away and that it is portable. Guecelevich explained which tests Smart Solutions can run to prove that the system works. The first system, he wrote, is intercepting technology; the second is a passive system that can intercept GSM communication which Guecelevich promised can process 32 channels simultaneously, record conversations, among other capabilities.

It's not only domestic spying problems, either. From CBS News:

[Ecuador] ranks 119th out of 179 countries on Reporter Without Borders'?Press Freedom Index, and Human Rights Watch?says?"President Rafael Correa has undercut freedom of the press in Ecuador by subjecting journalists and media figures to public denunciation and retaliatory litigation."

Before Snowden can get there, he has other serious hurdles. He's currently in Russia ? likely having a chat with their intelligence agents ? and without a valid U.S. passport, his travel plans are temporarily halted.

But even given the ability to leave Russia for Ecuador ? he faces stiff opposition from business leaders, who see a potential threat to the?40 percent of exports purchased by the United States.

With a trade deal expiring at the end of July, the U.S. has serious leverage of?$9 billion per year.

"What would we gain from giving political asylum to Snowden ? confirming Ecuador's international image as an anti-imperialist country?" the?head of the Ecuadorian Business Committee, Roberto Aspiazu, told AFP. "I?don't think we need that."

Well, what do we have here? Okay, let's scrap the faux surprise. The recently confirmed Ascend P6 has landed, and Huawei hopes it will stir interest in the hearts of mobile users. Debuting across Europe, China and Australia in late June / early August with a €449 ($600) price tag, it's asking you to take it seriously, and that's what we'll do.

The mobile market is a fickle place, so it doesn't matter where you are right now; it's all about where you're going. Huawei? Well, it's definitely got its sights set on an upward trajectory. The Ascend P6 is the latest rung on the ladder, intended to elevate the company to mobile greatness. But, with competition stiffer than ever, can it really call a device with a 1.5GHz quad-core processor, 720p display and 8-megapixel camera a flagship? (For its P-series at least?) Huawei's certainly giving it a try, and it's hoping that beauty, not brawn, will win the day.
